{"id":11977,"date":"2026-03-13T16:41:21","date_gmt":"2026-03-13T15:41:21","guid":{"rendered":"https:\/\/termechianciano.it\/?page_id=11977"},"modified":"2026-03-13T17:15:45","modified_gmt":"2026-03-13T16:15:45","slug":"general-terms-and-conditions-of-sale","status":"publish","type":"page","link":"https:\/\/termechianciano.it\/en\/general-terms-and-conditions-of-sale\/","title":{"rendered":"General Terms and Conditions of Sale"},"content":{"rendered":"<div data-elementor-type=\"wp-page\" data-elementor-id=\"11977\" class=\"elementor elementor-11977\" data-elementor-post-type=\"page\">\n\t\t\t\t<div data-particle_enable=\"false\" data-particle-mobile-disabled=\"false\" class=\"elementor-element elementor-element-fcc7ebc e-flex e-con-boxed e-con e-parent\" data-id=\"fcc7ebc\" data-element_type=\"container\" data-settings=\"{&quot;jet_parallax_layout_list&quot;:[]}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-09684f8 elementor-widget__width-inherit elementor-widget elementor-widget-heading\" data-id=\"09684f8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">General Terms and Conditions of Sale<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-54f66f7 elementor-widget__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"54f66f7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h5><strong>Article 1 - Purpose and Scope<\/strong><\/h5><p>These General Terms and Conditions of Sale (hereinafter referred to as \u201c<strong>CGV<\/strong>\u201d) govern the terms and conditions of purchase and use of admissions, services and products offered by TERME DI CHIANCIANO S.P.A. at the thermal park located in Chianciano Terme (53042 - SI), Viale Roma, 103 (hereinafter the \u201c<strong>Seller<\/strong>\u201dor the \u201c<strong>Structure<\/strong>\u201d).<\/p><p>The purchase can be made:<\/p><ul><li>through the official online shops available at the following addresses<\/li><\/ul><p><a href=\"https:\/\/termechianciano.it\/en\/theia-thermal-pools\/\">https:\/\/termechianciano.it\/en\/theia-thermal-pools\/<\/a>;<\/p><p><a href=\"https:\/\/termechianciano.it\/en\/sensory-spa\/\">https:\/\/termechianciano.it\/en\/sensory-spa\/<\/a>;<\/p><p><a href=\"https:\/\/termechianciano.it\/en\/gives-chianciano-spa\/\">https:\/\/termechianciano.it\/en\/gives-chianciano-spa\/<\/a> \u00a0\u00a0\u00a0<\/p><p>(each hereinafter referred to as the \u201c<strong>Website<\/strong>\u201d);<\/p><ul><li>at the reception desks of the Theia Thermal Pools and the Sensory Spa (the \u201c<strong>Reception<\/strong>\u201d).<\/li><\/ul><p>Transactions are governed by the provisions of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), Legislative Decree no. 70 of 9 April 2003 (E-Commerce), as well as - with regard to the protection of personal data - by EU Regulation 2016\/679 (GDPR) and Legislative Decree no. 196\/2003 as amended.<\/p><p>\u00a0<\/p><h5><strong>Article 2 - Acceptance of the GTC<\/strong><\/h5><p>By purchasing via the Site or at the Reception, the Customer declares that he has read and accepted these GTC in full and without reservation.<\/p><p>The purchase of admissions, services and products - whether through the Site or Reception - also implies full acceptance by the Customer of the Rules and Regulations containing the rules of conduct to be observed within the structure, which can be consulted at the following links\u00a0 <a href=\"https:\/\/www.termechianciano.it\/wp-content\/uploads\/2025\/01\/Piscine-Termali-Theia-Regolamento.pdf\">https:\/\/www.termechianciano.it\/wp-content\/uploads\/2025\/01\/Piscine-Termali-Theia-Regolamento.pdf<\/a><\/p><p>The Seller reserves the right to amend or update these GTC at any time. The applicable GTC shall be those in force on the date of purchase.<\/p><p>\u00a0<\/p><h5><strong>Article 3 - Types of admissions and purchasable services<\/strong><\/h5><p>The Vendor offers the following types of products and services.<\/p><ol><li><strong>(a) Date-certain tickets<\/strong><\/li><\/ol><p>Product that enables <strong>access to the Day SPA on a specific date<\/strong>, which may include treatments, massages or wellness courses indicated on the Site.<\/p><p>The included services must be used on the selected date.<\/p><ol><li><strong>b) Gift Voucher<\/strong><\/li><\/ol><p>\u00a0Gift voucher allowing access to the Day SPA and\/or specific wellness services offered by the Facility.<\/p><p>The date of use must be <strong>booked later<\/strong> via the Site or by contacting Reception <strong>at least 7 days before <\/strong>of the date of use.<\/p><ol><li><strong>c) Monetary Gift Card. <\/strong><\/li><\/ol><p>A voucher with a monetary value available in various amounts, which can be used to purchase Day SPA admissions or facility services until the available credit is exhausted. The Monetary Gift Card can only be redeemed online and can be used in several instalments until the credit is exhausted.<\/p><ol><li><strong>d) Multiday Pass<\/strong><\/li><\/ol><p>Package consisting of several Day SPA admissions, which can be used progressively, subject to reservation via the Site or by contacting Reception.<\/p><p>\u00a0<\/p><h5><strong>Article 4 - Issue of purchase order<\/strong><\/h5><p>Following the purchase of inputs, services or products offered by the Seller illustrated in Article 3 above, the Customer shall receive a digital or paper identification document (hereinafter the \u201c<strong>Purchase Title<\/strong>\u201dor \u201cTitle\u201d).<\/p><p>The Purchase Title:<\/p><ul><li>is identified by a unique alphanumeric code;<\/li><li>constitutes an entitlement to access the purchased services;<\/li><li>must be presented when using the services at the facility.<\/li><\/ul><p>\u00a0<\/p><h5><strong>Article 5 - Obligations of the Client<\/strong><\/h5><p>The Customer is obliged to read these GTC before proceeding with the purchase.<\/p><p>Making a purchase via the Site or at Reception implies full knowledge and acceptance of these GTC.<\/p><p>The Customer also undertakes to<\/p><ul><li>provide correct and up-to-date personal data;<\/li><li>carefully guard the purchase order received;<\/li><li>comply with the facility's regulations.<\/li><\/ul><p>The customer is responsible for <strong>custody of the Purchase Order Identification Code<\/strong>, necessary to access the services purchased.<\/p><p>\u00a0<\/p><h5><strong>Article 6 - Conclusion of the Contract<\/strong><\/h5><p>All prices shown on the Site or at Reception are in Euros and include VAT, unless otherwise indicated.<\/p><p>The contract shall be deemed to have been concluded and legally binding at the time when:<\/p><ul><li>The Customer has made full payment of the price of the service or product selected;<\/li><li>The Seller issued the relevant Purchase Order<\/li><\/ul><p>In the case of a purchase made via the Site, the Purchase Order will be sent to the e-mail address provided by the Customer during the registration or purchase procedure. In case of purchase at the Reception, the Purchase Title will be delivered directly to the Customer in paper or digital format.<\/p><p>Any errors in the data provided by the Customer must be reported promptly by contacting Reception at the contact details indicated on the Site.<\/p><p>\u00a0<\/p><h5><strong>Article 7 - Validity and Use of Purchase Securities<\/strong><\/h5><p>Except in the case of a dated Ticket, the issuance of the Purchase Order does not constitute an automatic reservation of the service.<\/p><p>Reservations must be made by contacting the property by e-mail or via the Site.<\/p><p>On the day of booking, the Customer must present the Purchase Order at Reception.<\/p><p>Unless otherwise specified, the Purchase Order <strong>is valid until the expiry date indicated on the licence<\/strong>. After that period, the Purchase Order <strong>lapses automatically, with no possibility of reimbursement<\/strong>.<\/p><p>If the Purchase Order includes several services, they must be used on the same day, unless otherwise specified.<\/p><p>\u00a0<\/p><h5><strong>Article 8 - Temporarily unavailable services<\/strong><\/h5><p>The Facility reserves the right to modify or temporarily suspend certain services for:<\/p><ul><li>technical or maintenance requirements;<\/li><li>organisational reasons;<\/li><li>extraordinary events or Force Majeure, as defined in Article 9 below.<\/li><\/ul><p>Should one or more services included in the Purchase Order be temporarily unavailable, the Customer may:<\/p><ul><li>take advantage of alternative services of equal value;<\/li><li>obtain an extension of the validity of the Purchase Order limited to the period of unavailability.<\/li><\/ul><p>No further compensation or reimbursement is provided.<\/p><p>\u00a0<\/p><h5><strong>Article 9 - Force Majeure<\/strong><\/h5><p>Force majeure shall be understood to mean all extraordinary, unforeseeable and unavoidable events, not attributable to the Vendor and not surmountable by ordinary diligence, which prevent or temporarily make impossible, in whole or in part, the provision of the services offered by the Facility.<\/p><p>Cases of force majeure include, but are not limited to:<\/p><ul><li>natural disasters (such as earthquakes, floods, landslides or exceptional weather events);<\/li><li>fire, explosion or major technical failure of the facility's installations;<\/li><li>prolonged interruptions in the supply of electricity, water or other essential services;<\/li><li>epidemics, pandemics or health emergencies;<\/li><li>measures of public authorities restricting or preventing access to the facility or the provision of services;<\/li><li>strikes, labour unrest or other circumstances beyond the Seller's control.<\/li><\/ul><p>In the event of force majeure events, the Seller shall not be liable for any inability to provide the purchased services.<\/p><p>In such cases, the Customer shall have the right, at the Seller's option:<\/p><ul><li>to use the purchased services at a later date, subject to the availability of the facility; or<\/li><li>to obtain an extension of the validity of the Purchase Order limited to the period of unavailability.<\/li><\/ul><p>The Customer's right to any further indemnity, reimbursement or compensation is excluded<strong>.<\/strong><\/p><p>\u00a0<\/p><h5><strong>Article 10 - Loss or theft of the Purchase Order<\/strong><\/h5><p>The Seller shall not be liable for any <strong>loss, theft or misuse of the Purchase Order<\/strong>.<\/p><p>\u00a0<\/p><h5><strong>Article 11 - Changes to the reservation<\/strong><\/h5><p>Any changes to the reservation must be communicated <strong>by 10 a.m. on the previous day<\/strong> on the date booked.<\/p><p>In the event of late communication or <strong>no-show<\/strong>, the Purchase Order shall be deemed to have been used.<\/p><p>\u00a0<\/p><h5><strong>Article 12 - Right of withdrawal<\/strong><\/h5><p>Pursuant to Article 52 of the Consumer Code, a customer who has made a purchase via the Site has the right to withdraw from the contract <strong>within 14 days from the date of purchase<\/strong>, provided that the Purchase Order has not been used.<\/p><p>The right of withdrawal does not apply to Tickect on a date certain as falling under leisure activities with a specific date or period of performance, pursuant to Art. 59 lit. n) of the Consumer Code.<\/p><p>The withdrawal request can be sent via:<\/p><p>PEC: <a href=\"mailto:segreteria@pec.termechianciano.it\">segreteria@pec.termechianciano.it<\/a><\/p><p>Registered mail: Terme di Chianciano S.p.A - Viale Roma 103 - 53042 Chianciano Terme (SI)Manciano (GR)<\/p><p>In the event of a valid withdrawal, the amount will be refunded <strong>within 14 days<\/strong> from receipt of the communication.<\/p><p>\u00a0<\/p><h5><strong>Article 13 - Complaints and Assistance<\/strong><\/h5><p>For information or reports, please contact the number:<\/p><p>- E-mail: <a href=\"mailto:prenotazione@termechianciano.it\">prenotazione@termechianciano.it<\/a><\/p><h5>\u00a0<\/h5><h5><strong>Article 14 - Applicable Law and Jurisdiction<\/strong><\/h5><p>The GTC are governed by Italian law.<\/p><p>Any disputes shall be settled by the Court of the place of residence or domicile of the Customer, if located in Italy.
